GENERAL CONDITIONS GINCHALET

When you book a holiday, it is nice to know in advance where you stand. Read below about the payment options, rules regarding cancellation and rebooking and the rules for if you bring a dog.

1. APPLICATION

These General Terms and Conditions apply to reservations of holiday homes rented out by GinChalet, hereinafter referred to as GinChalet/we. These general terms and conditions are valid for bookings made on or after the validity date mentioned above.

When making a booking you must have read and agreed to the general terms and conditions. The conditions apply from this moment on.

In these General Terms and Conditions, the terms 'renter' and 'you' are defined as: the person who enters into an agreement with GinChalet regarding the rental/use of our holiday homes. The term 'user' (also referred to below as 'guest') is understood to mean: the tenant and the persons specified by the tenant who (will) use the holiday home and/or other facilities rented by the tenant.

Agreements deviating from these General Terms and Conditions are only valid if agreed in writing.

The agreement between you and Ginchalet is exclusively governed by Dutch law.

2. BOOKING

A request for a reservation for a Ginchalet holiday home can be made via the internet, by email or by telephone. Receipt is confirmed with a request for (down) payment.

Our holiday homes are ONLY intended for recreational use. Commuting is NOT allowed (partly) due to local rules.

Booking a GinChalet holiday home is only possible if you are over 18 years old.

Our holiday homes cannot be rented for (bachelor) parties and/or similar events.

We reserve the right to refuse a reservation at any time - without giving reasons.

After booking you will receive a confirmation from us, which also serves as an invoice. Check immediately whether the data is correct. We would like to hear about any inaccuracies immediately. A booking is made when GinChalet has confirmed the reservation to you.

We do not charge booking or service fees.

3. PAYMENT

The following payment terms apply:

  • Within 24 hours of booking o
    • 30% of the rental amount.
  • 6 weeks (42 days) before arrival o
    • 70% of the rental amount.
  • For a booking with arrival within six weeks (42 days) 
    • Within 24 hours of booking: 100% of the rental amount.

If you do not pay the rent on time, you will receive a message from us by e-mail. We will set a new payment term. If payment is not made on time again, the rental agreement will be cancelled and GinChalet has the right to charge the cancellation costs due.

4. CANCELLATION

Is your holiday unexpectedly cancelled? Please observe the following cancellation conditions, valid for bookings via www.ginchalet.nl:

  • 24 hours before arrival
    • Free, you will receive 100%, of the booking amount already paid, back.
  • On day of arrival or during stay
    • You will receive 0% of the booking amount back.

You can cancel by sending an email to contact@ginchalet.nl.After a cancellation, any refund will be made by GinChalet within five working days.

The right of withdrawal does not apply to our services.

GinChalet has the right to revoke your booking up to 48 hours after the time of booking, stating reasons.

5. CHANGES

Changing the date or holiday home is possible up to 24 hours before arrival, subject to availability.

It is possible to book additional extras at any time, based on availability. Early check-ins and/or lazy check-outs are excluded, these can be booked up to 24 hours before check-in or check-out.

In the event of a difference in the rental amount, the difference will be borne by the guest. This difference must be paid before the payment term communicated by GinChalet.

If you wish to make changes to the agreement after the conclusion of the agreement, GinChalet is not obliged to accept them.

If, due to other circumstances, GinChalet needs to make a change to a reservation you have booked with regard to location, period of stay or the type and/or location of the holiday home, GinChalet can offer you a suitable alternative.

The tenant and other users are not permitted to use the holiday home under any name and for whatever reason to persons other than the persons mentioned in the agreement, unless otherwise agreed in writing with GinChalet.

If you wish to end your period of stay prematurely or transfer it to another user, you remain jointly and severally liable to GinChalet for the stay of the new user as well as the payment of the part of the rental sum still owed, any additional costs resulting from the transfer and any cancellation costs.

6. CHECK-IN AND CHECK-OUT

The rented holiday home is available from 3 p.m. on the agreed arrival day.

Leaving luggage and/or parking cars or bicycles before check-in and/or after check-out is only permitted in consultation.

Check-in and check-out take place by handing over the key.

A personal parking space will be allocated upon check-in, valid for the entire stay and suitable for one car.

On the agreed departure day, the holiday home must be left tidy and the keys must be returned to the manager before 10:00 am.

If the use of the holiday home and/or other facilities is terminated earlier than on the agreed date stated on the confirmation of the reservation, the tenant is not entitled to a refund of (part of) the rental price and/or costs by GinChalet.

We make the key to the holiday home available to the tenant on loan. The key remains the property of GinChalet. In the event of loss, breakage, theft or any other form of loss of the key, the tenant is obliged to compensate the damage.

7. STAY

All guests must adhere to the rules set by GinChalet for the park and our holiday homes, recorded in the house rules. These regulations can be found in the information folder in the holiday home.

In the event of violation of the rules included in these General Terms and Conditions, the house rules and/or failure to follow instructions from the staff, GinChalet has the right to remove you, the tenant and any other user from the park, without refund of the rental amount or part of it takes place.

It is not permitted to accommodate more people than specified when making the reservation and stated on the confirmation. Would you like to receive guests? Please report this to the manager in advance and pay the mandatory tourist tax. Our holiday homes have a maximum number of people of 2-7, babies and children also count towards the total. If the stated number is exceeded, GinChalet has the right to terminate the agreement, the cancellation conditions apply.

GinChalet reserves the right to make changes to the design and access to the park facilities, without you being entitled to compensation.

Moving the inventory or taking any part of the (indoor) inventory outside is expressly not permitted, with the exception of the crockery/glasses and cutlery for your meal outside. The use of equipment, inventory and facilities other than for which they are intended is also not permitted.

You are not entitled to compensation for necessary or everyday maintenance of the holiday home or its facilities.

The tenant must leave the holiday home tidy (i.e.: do not leave dirty dishes, leave the floor tidy, remove bed linen, clean the kitchen and refrigerator, place garbage bags in the container).

If the park manager seriously suspects that the tenant of the holiday home is acting contrary to the law and/or public order and/or good morals, the manager is entitled to gain access to the holiday home.

8. SMOKING AND FIRE

Our holiday homes are non-smoking. It is also not permitted to use or possess drugs or narcotics at our parks.

Smoking is only allowed outside. Far away from open windows and doors. There is a container with sand for cigarette butts.

Open fire is always prohibited. Burning candles without anyone present and throwing away cigarettes, cigars and matches are also prohibited. Incendiary explosive substances are prohibited.

Barbecuing is allowed provided that the barbecue is at least 3 meters from trees, shrubs, fences, buildings and the holiday accommodation. In addition, it is mandatory to have a bucket with 10 liters of water within reach. You may only use electricity, gas, charcoal and briquettes as fuel for the barbecue.

The manager may prohibit the use of a barbecue in special circumstances (for example extreme drought).

9. PETS

A maximum of 3 dogs are allowed in the following houses: Damrak and Casa de Gloria. The other houses are pet-free and admitting a pet is not permitted.

In houses where a dog is allowed, pets other than a dog are not allowed. GinChalet reserves the right to refuse pets at the park (without stating reasons).

If you and/or other users wish to bring a dog, you must indicate this immediately when booking. In that case, GinChalet will charge you a surcharge, which you will pay. Visitors' pets are not allowed.

The dog must be kept on a leash outside the holiday home and garden. Instructions on site must be followed. The dog may not cause any nuisance to other guests and local residents.

10. PRICES

The agreed rental price, as stated in the booking confirmation, applies to you.

Price discounts and/or special offers can no longer be used once confirmation of the reservation/invoice has been sent by GinChalet.

GinChalet has the right to implement and settle price increases as a result of interim adjustments to legal regulations or provisions (including, but not limited to, VAT, tourist tax, insurance tax) over which GinChalet has no influence. The amount of the tourist tax is determined by the municipality of Putten.

11. FORCE MAJEURE AND MODIFICATION

In the event that GinChalet is unable, temporarily or otherwise, to execute the agreement in whole or in part due to force majeure, we will submit a change proposal (for another holiday home/other period, etc.). The suspension of the fulfillment of the obligations by GinChalet is permitted if circumstances beyond the control of GinChalet arise. GinChalet will under no circumstances be obliged to compensate any damage or costs.

Force majeure on the part of GinChalet exists if GinChalet is prevented from performing the agreement in whole or in part, temporarily or otherwise, due to circumstances beyond the control of GinChalet, including danger of war, strikes, blockades, fire, epidemics, floods and other malfunctions or events.

GinChalet has the right to terminate the agreement with immediate effect at any time if personal data of you and/or other users is incomplete and/or incorrect when making a reservation. In such a case, no refund of the rental amount or part thereof will take place.

12. LIABILITY - DAMAGES - COMPLAINTS

During the relevant rental period in the rented holiday home, the tenant and other users are fully liable for all damage caused to the house, the inventory and all items belonging to the rented object, unless the tenant and other users can demonstrate that the damage to cannot be attributed to them. If you notice any damage or defects, please report this to us immediately. Costs in the event of damage will be charged to the tenant by GinChalet.

GinChalet is under no circumstances liable for theft, loss or damage of or to property or persons, of any nature whatsoever, during or as a result of the stay in the holiday home and/or on the grounds.

Additional costs will be charged if the holiday home is not used correctly or if it is not left behind properly, including if the holiday home is not left clean. After GinChalet determines additional costs, you/tenant are obliged to pay them in accordance with the payment term set by GinChalet.

GinChalet is not liable for construction activities on the access and main roads, etc. in the vicinity of the rented holiday home. GinChalet is not liable for the failure or (partial) deactivation of technical equipment, utilities and/or the non-functioning or partial non-functioning of the internet.

The costs of normal maintenance and repair of defects are at our expense. If any defects occur, you must inform us immediately and follow our instructions as much as possible.

If you want to file a complaint, you can do so during your stay or at check-out. If your complaint has not been addressed satisfactorily, please report your complaint in writing to contact@ginchalet.nl no later than 14 days after departure.
